On 2 August, the EU's AI transparency rules started to apply.
Most SME owners I speak to assume this means labelling every AI-written email.
=> It doesn't.
What Article 50 actually asks, in plain terms:
- People must be told when they are interacting with an AI system, unless it's obvious. That's your website chatbot — and if it runs under your own name, that duty can be yours.
- Deepfakes get labelled.
- Published text that informs the public on matters of public interest gets labelled too.
Unless a human with real knowledge of the subject reviewed the substance of it. The Commission's own guidance is explicit that spell-checking doesn't count.
So the quotes your team drafts with AI, the inbox triage, the invoice data nobody retypes anymore — out of scope.
Read that exemption again, because it's the interesting part.
Brussels just wrote a design principle into law: AI can prepare the work, a human has to own it.
That was never a compliance burden.
It's the only version of AI automation that was ever safe to put in front of a customer.
Two things worth doing this month:
- Check whether your chatbot tells people it's AI.
- Then name the person who approves AI output before it reaches a client.
Most teams can't answer the second one.
Who signs off on AI-drafted work in your business before it goes out?
